With a serverset at a 32-40 player max must the server be locked and PW'ed?

You mean, 40 being the max amount of players that can join? Well, you can see the max amount of players in the serverbrowser. Don't think pw-ing the box is the way to go?

I guess the question is more about licenses.
I don't think all unpassworded servers have to have 64 slots, but I'll let a server admin/dev answer that.
