Playing on Al Basra as Insurgent, I was able to pick up British crewman kit and keep it unpunished. The way it happened might be interesting too. I grabbed this kit by a half-destroyed British FOB, checked it and pressed the button to get my previous kit back. But my insurgent's kit wasn't there, it disappeared (it happened to me before in 1.0 when kits disappear next to a FOB).
I panicked first, since no more friendly kits were nearby and I was pretty far from a cache and action. But then I noticed that I'm not getting punished for keeping the British Crewman kit, and I kept it with me. No warning message appeared either.
Edit: the unpunishable enemy kit and disappearance of my previous kit probably are two different unrelated bugs.

Happened to me on Lashkar too. I think my original kit was still there though (but im not 100% sure, there were too many friendly kits where i picked up the german kit).
