Managed to get it once before the .61 patch but got nailed before I could do anything.

I know someone got it on Desert Storm and I had numerous occasions, where the kit was in front of me and I could pick it up after knifing a civi

What happens if you do pick it up? Do you become a civvy and the ins. have to knife you or do you stay a soldier and just have a crappy kit?

You're a soldier, who basically can only fight with rocks, but I'm not sure if the engagement rules imply to you then..
