vehicle tk bug?

heres to hoping this problem isnt hardcoded...

just saw some videos of a smacktard who right before the vehicle hes driving hits someone he switches seats and the vehicle rams the person but it doesnt count as a tk against him..

this is gonna make the game hell basically now alot of the smacktards will start employing it...
