I agree, a positive response from EA is quite likely on this. BF2 is clearly on the way out, in another year it'll be obsolete, and I'm sure at this point any improvements that can be done by modders will be overlooked or condoned by EA.If instructions are provided how to hex edit the .exe I don't imagine there will be any problems. The game is old and EA wont care about such a minor issue.
It's worth a shot to see if it works. If it does then the devs can consider whether to distribute this and possibly obtain permission.

PR already breaks the EULA in worse ways (tons of stolen content), and yeah, I know the story about how an EA employee told a dev at a cocktail party that they could use the content and it won't really be a problem. (Morally I agree that that gives you the right, but not legally.) That verbal consent would not stand up AT ALL if EA cared that you were using the content. EA clearly doesn't care.
You should just do it. Furthermore, the devs can protect themselves by not officially distributing the hacked server, instead let some community member do it, or not even distribute the exe but distribute a normal exe plus instructions on how to hex edit it, or even a program/batch file that you run to make the edits.
Or if that link above works, just use that server, then you aren't distributing it, that guy is lol...
EA's eulas and stuff are to protect themselves against loss of revenue through stuff like industrial espionage where a competitor could hack into their game and steal some cool way of doing things, or to protect themselves against malicious people breaking their game or giving them a bad name. They also have rules to protect against piracy. Well, if PR distributes a modified server, that's not going to help a single person play BF2 without buying it.
If PR manages to get bf2 working with 128 players EA isn't going to care at all. And if they even did, then no problem, you just take down the links to the 128 player version and bam you are fine.

Has anyone ever bothered to contact EA on this matter? I know they arent the leading figure in customer service but they have to respond to something like this.
Dude, it took them two days to respond to a valid customer question of mine. I don't think their support staff gives a **** about modifications, and their DEV team and management are now working on BF3 and other EA ventures. So unless someone knows of someone who REALLY wants to talk, doesn't seem that worth it. But filing a help desk tickets isn't going to go anywhere.

No, EA would prefer the BF2 community dies and we move to a new game, such as Crysis, so EA gets more money. so... has anybody tried when running the dedicated server just throwing in the +maxplayers <int> flag when running the server... tried it alittle bit ago and worked fine created a local server and it showed up as 0/128.

Also... there was a test with a edited server exe before and it didn't work, it turns out it is hard coded in the client as well. So someone may want to look into that as well...
